These Terms of Service (“Terms”) govern your use of the PhotoLog Android application and the photolog.ca website, both operated by BESTAPP Digital (“we,” “us,” “our”), a Canadian software business based in British Columbia.

By creating an account or using PhotoLog, you agree to these Terms. If you do not agree, please do not use the app. If you have questions, contact us at bestappdigital@gmail.com.

PhotoLog lets you capture photos tagged with GPS location, timestamps, and typed or dictated notes, organize them under searchable session keys, and export them as a ZIP file containing images, a CSV summary, and a formatted HTML field report.

PhotoLog is a documentation and organization tool. It is not a survey-grade positioning device, a legal record-keeping system, or a substitute for professional judgment in any field where accuracy is safety- or compliance-critical.

You need an account to use PhotoLog. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

PhotoLog is not directed at children under the age of 13, and you must meet the minimum age required to enter into a binding agreement in your jurisdiction to create an account.

PhotoLog offers a Monthly and an Annual subscription plan, both processed through Google Play Billing. By subscribing, you authorize Google Play to charge your selected payment method on a recurring basis until you cancel.

• Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• Cancellation: You can cancel anytime through your Google Play account subscription settings. Cancelling stops future renewals; it does not retroactively refund the current billing period.
• Refunds: Refund requests are handled according to Google Play’s refund policies, since Google Play processes all payments on our behalf.
• Price changes: If we change subscription pricing, we will provide notice before the change applies to your next renewal.

A free PhotoLog account can capture and store up to 24 images. Once that limit is reached, capturing additional photos requires an active Monthly or Annual subscription. We may adjust the free tier limit or feature availability in future versions, with reasonable notice for any significant reduction.

You are solely responsible for the content you capture and export using PhotoLog, and for making sure you have the right to photograph and document whatever you choose to.

You agree not to use PhotoLog to:

• Violate any applicable law, regulation, or the privacy rights of others
• Attempt to interfere with, disrupt, or reverse-engineer the app or its backend services
• Circumvent the free tier limit or subscription billing through unauthorized means
• Use the app in any way that could harm BESTAPP Digital, other users, or third parties

We reserve the right to suspend or terminate accounts that violate these Terms.

PhotoLog is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.

To the fullest extent permitted by law, BESTAPP Digital is not liable for any indirect, incidental, or consequential damages arising from your use of the app, including loss of photos, notes, or other data stored locally on your device. We strongly recommend regularly exporting and backing up important field data using the app’s built-in export feature.

You may stop using PhotoLog and request account deletion at any time by contacting bestappdigital@gmail.com, as described in our Privacy Policy. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For significant changes — particularly to billing or subscription terms — we will notify users within the app before the change takes effect.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
